TERMS OF SERVICE AGREEMENT

Please read these Terms of Service ("Agreement", "Terms of Service") carefully before using amanuensisbraille.com ("the Site") operated by Amanuensis Braille ("us", "we", or "our"). This Agreement sets forth the legally binding terms and conditions for your use of the Site at amanuensisbraille.com.
By accessing or using the Site in any manner, including, but not limited to, visiting or browsing the Site or contributing content or other materials to the Site, you agree to be bound by these Terms of Service. Capitalized terms are defined in this Agreement.
Intellectual Property
The Site and its original content, features and functionality are owned by Amanuensis Braille and are protected by international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws. As a member you are entitled to print as many copies of the worksheet and graphic pages as you want for use in your classroom or with your students/children. You may not make an electronic copy of the worksheet or graphic pages for any purpose other than to facilitate the printing process. You may not distribute, reproduce, modify, or republish the worksheet or graphic pages contained on this site for any purpose other than the ones expressly defined above.
Termination
We may terminate your access to the Site, for any violation of this Terms of Service Agreement, which may result in the forfeiture and destruction of all information associated with you. All provisions of this Agreement that by their nature should survive termination shall survive termination.
Products and Services Refund Policy
All products and services will be performed in a timely manner according to industry standards. Any disputes over the quality of the product or service will entitle the customer to a refund for the product or service requested. The customer must return all products or materials received within 30 days of purchase in order to qualify for a full refund. Refunds will be issued as soon as the product or related materials are returned to Amauensis Braille. The customer is responsible for all return shipping fees.
Worksheets and Graphics Website Refund Policy
Either party may terminate the online account Agreement for cause upon 30 days’ written notice of a material breach to the other party if such breach remains uncured at the expiration of such period.
Upon any termination for cause by Customer, Amanuensis Braille shall refund to Customer any prepaid fees covering the
remainder of the Subscription Term for the online account after the effective date of termination. Notwithstanding the foregoing, termination for
cause by Customer shall not relieve Customer of the obligation to pay any fees accrued or payable to Amanuensis Braille prior to
the effective date of termination.
Customer Responsibilities
Customer is responsible for all activities that occur in Customer’s account(s). Customer shall: (a) have sole responsibility for the accuracy, quality, integrity, legality, reliability, and appropriateness of all
Data; (b) prevent unauthorized access to, or use of, the Platform, and notify Amanuensis Braille promptly of any such unauthorized
access or use of which Customer becomes aware; (c) ensure that a user login is only used by one
person (a single login shared by multiple persons is not permitted); (d) maintain the security of its users’ account names and
passwords; and (e) comply with Applicable Law with respect to Data uasage when accessing the Worksheets and Graphics Website.
Term of Subscriptions
Subscriptions to the Platform commence on the Date of Purchase and
continue for a One Year Term. Subscription to a Silver membership will grant you access to our database of K-6 grade worksheets. Subscription to Gold membership will grant you access to our database of K-12 grade worksheets. Subscription to Platinum membership will grant you access to our database of K-12 grade worksheets and our Graphic Templates database.
Taxes
Unless otherwise stated, Amanuensis Braille’s fees do not include any direct or indirect local, state, federal or foreign taxes, levies, duties or similar governmental assessments of any nature, including value-added, use or
withholding taxes (collectively, “Taxes”). Customer is responsible for paying all Taxes associated with its purchases
hereunder, excluding taxes based on Amanuensis Braille’s net income or property. If Amanuensis Braille has the legal obligation to pay or
collect Taxes for which a Customer is responsible under this Section, the appropriate amount shall be invoiced to and paid by
Customer, unless Customer provides Amanuensis Braille with a valid tax exemption certificate authorized by the appropriate taxing
authority.
Governing Law
This Agreement (and any further rules, polices, or guidelines incorporated by reference) shall be governed and construed in accordance with the laws of California, United States, without giving effect to any principles of conflicts of law.
Changes To This Agreement
We reserve the right, at our sole discretion, to modify or replace these Terms of Service by posting the updated terms on the Site. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms of Service.
Please review this Agreement periodically for changes. If you do not agree to any of this Agreement or any changes to this Agreement, do not use, access or continue to access the amanuensisbraille.com site.
